Welcome to teeplug.ca (the "Site"). This Site is owned and operated by TeePlug Apparel ("TeePlug", "we", "us", or "our"), doing business as TeePlug. These Terms and Conditions ("Terms") govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site, and your purchase of products ("Products") from the Site.

By accessing or using the Site, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at teeplug.ca/privacy-policy, incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site.

1. Use of the Site

Eligibility: This Site is intended for users who are at least the age of majority in their jurisdiction of residence (typically 18 or 19 in Canadian provinces). By using this Site, you represent and warrant that you meet this requirement.
Permitted Use: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms for the purpose of Browse Products and making purchases for personal, non-commercial use.
Prohibited Uses: You agree not to use the Site:

- To use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site, without our prior written consent.
- To introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
Account Security: If you create an account on the Site, you are responsible for maintaining the confidentiality of your account login information (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You must provide accurate and complete information and keep your account information updated.

2. Products and Orders

Product Information: We strive to display accurate Product descriptions, images, and prices on the Site. However, we do not warrant that Product descriptions, colours, pricing, or other content on the Site are accurate, complete, reliable, current, or error-free. Colours may vary depending on your monitor settings. Measurements may be approximate.
Pricing: All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Prices are subject to change without notice. Prices do not include applicable taxes (such as HST/GST/PST) or shipping and handling charges, which will be added to your total price at checkout.
Order Acceptance: Your placement of an order does not necessarily assure that we will accept your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to Product availability, errors in Product or pricing information, or issues identified by our fraud detection services. If we cancel an order after payment has been processed, we will issue a full refund. An order is considered accepted by us only when we ship the Product(s).
Payment: We use Stripe as our third-party payment processor. By providing payment information, you represent and warrant that you are authorized to use the designated payment method. You authorize us (through Stripe) to charge your payment method for the total amount of your order, including taxes and shipping. Payment processing is subject to Stripe's terms and privacy policy.
Shipping: Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments. Risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier. Please refer to our Shipping Policy for more details.
Returns and Refunds: Please refer to our Return & Refund Policy for details on returning Products and requesting refunds.

3. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by TeePlug, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are permitted to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.
You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Our name "TeePlug", the parent company name "TeePlug", our logos, and all related names, logos, product and service names, designs, and slogans are trademarks of TeePlug or its affiliates or licensors. You must not use such marks without our prior written permission.

YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER TeePlug NOR ANY PERSON ASSOCIATED WITH TeePlug MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.

WITHOUT LIMITING THE FOREGOING, NEITHER TeePlug NOR ANYONE ASSOCIATED WITH US REPRESENTS OR WARRANTS THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL TeePlug, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, OR ANY SERVICES OR PRODUCTS OBTAINED THROUGH THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO YOUR ORDER OF PRODUCTS FROM THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) IN QUESTION.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (WHICH MAY INCLUDE LIABILITY FOR GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT, DEPENDING ON THE JURISDICTION).

You agree to defend, indemnify, and hold harmless TeePlug, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.

7. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal or provincial courts located in London, Ontario, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country or province of residence or any other relevant jurisdiction. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

8. Changes to Terms and Conditions

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. The "Effective Date" at the top of this page indicates when these Terms were last revised.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

We may terminate or suspend your access to all or part of the Site, including your account, for any or no reason, including without limitation, any violation of these Terms, without prior notice or liability.

10. Miscellaneous

Entire Agreement: These Terms and our Privacy Policy (and any other policies linked herein, like Shipping or Returns) constitute the sole and entire agreement between you and TeePlug regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
